CRASHING NERVES

Written by Captain Mary on Friday, October 24, 2008

Recently my daughter was in a traffic accident and if that's wasn't enough, things are just beginning to get bad. Her insurance representative called to let her know that my name is on her insurance policy as the holder, well I thought it was that way so that we would get a multiple car discount. Apparently, that isn't all it means, the insurance rep says the other party has retained an attorney and the possibility of suing me is real. They are going to offer a settlement to the injured party, but they may want more, that could mean they want my personal property or perhaps a lien on my house.
I do feel bad for their injuries, yet I was in no way involved in the accident and I would like to think that this great government of ours can see that. Now, I find myself very angry and worried, there has to be a way to cover myself from this kind of liability. I thought the reason we purchase insurance is to protect ourselves from malicious prosecution. I hope that I can keep all the things I worked so hard to keep, I would hate to think that I would be out on the streets for an accident that I didn't have any involvement in. The state of Florida is suppose to be a no-fault state and that is why we carry person injury protection, I hope that this is just as it says.
Tonight is a big night for me, I will be testing for my Black Belt in Taekwondo. I know everything that I am suppose to know, but when the time comes to perform, I hope that I don't have a senior moment or a brain fart. Wish me luck!!!

    Mary,

They're blowing smoke. Retain counsel of your own though.

I know you run a charter service, is it registered as an LLC? The smart thing even if it is a bit more expensive is to register and insure the vehicles under the corporate name.

With an LLC it truly is limited liability in all cases.

Ok Sis, Focus on your blackbelt-it's yours!!! You can't sweat things you have absolutely no control over. Everything will be fine. Your daughter will take care of everything for you, as she wouldn't ask you to forfeit anything, I know her.

The best of luck, and you will get through the accident deal.
    One day at a time.
